The Food Sovereignty Commission of the National Assembly ‘exhorted’ the State Attorney General’s Office to conclude the pre-procedural actions initiated against exporting companies that allegedly disrespect the payment of the minimum support price for a box of bananas, which is $6.25; action that harms the banana producing sector.
The legislative table made this call “so that the judicial instances have sufficient elements of conviction to continue the processes and, if necessary, execute the sanctions.”

The demand presented by the Commission is part of a non-binding report that it approved on the night of Monday, April 25, on the appearance of the Minister of Agriculture and Livestock, Pedro Álavaon Wednesday, April 20, in the city of Machala, in the province of El Oro, where he explained the measures he ordered for the banana sector, including the control exercised over exporters who do not respect the price of the fruit.
During the meeting, Álava undertook to present the complaints to the Prosecutor’s Office based on the lists that the Ministry has of the companies in which irregularities were detected.
Mariano Curicama, president of the Commission, He recalled that the plenary session of the National Assembly ordered that the legislative table follow up on the actions that Álava ordered to alleviate the serious crisis that the agricultural sector is going through.
Meanwhile, fruit producers and union representatives also participated in the appearance, before whom the minister assured that “all the suggestions (from the banana sector) of five meetings are registered, among them the purchase of banana bunches, the creation of a trust, the contingency fund, moratorium from six months to one year on debts, among others.”
The report also concludes that in accordance with article 226 of the Constitution, the Commission has limited itself to its supervisory role, since it lacks jurisdiction and competence to rule on the alleged commission of crimes, whose investigation and action corresponds to the pre-trial body and and to the competent judges, who must decide on the matter in the criminal sphere.
The aforementioned article states that the State institutions, their agencies, dependencies, public servants and persons acting by virtue of a state authority shall exercise only the powers and powers attributed to them in the Constitution and the law.
Meanwhile, the Commission recommended urging the functions of the State to comply with the constitutional, legal and regulatory provisions in force, in order to prevent illegal actions from taking place, which have repercussions on the actions of the institutions.
