Congress approves law so that Mypes receive payments in 30 days

The Plenary of Congress unanimously approved Law 286/2021-CR, which promotes the payment of fees and invoices from mypes within 30 days by public or private companies with the aim of promoting their economic reactivation and supporting micro and small business entrepreneurs (mypes).

“The main thing is that micro and small companies have a better bargaining position than they used to have. Currently, there is no balanced bargaining power, so payments could be made in up to 90 days. With 108 votes in favor, the law was approved during the decentralized session of the Plenary chaired by the President of Parliament, Maricarmen Alva Prieto. The congressman of Podemos Peru, Carlos Anderson, author of the law, stressed that micro and small companies constitute a very important sector, for the reactivation of the country and reaches 95% of the business fiber of Peru, so this measure will help to the economic reactivation of the mypes.

This law has as its main objective “the timely payment of commercial invoices rotated by private sector companies and the public sector in order to boost the dynamism of the economy through the timely provision of liquidity to the mypes ”, he says in the project.

Likewise, the document explains that, as soon as the good or service provided is delivered, the supplier must issue the invoice or receipt for the corresponding fees, which it grants to the private or public company a period of seven days to agree to the agreement to what is established in the purchase order. This agreement must be in writing by means of a corresponding charge.

“Giving them a bit of bargaining power, by giving them 30 days, will allow small companies to have access to working capital and it will not happen like in other parts of the world that the smallest finance the largest,” he said.
