The Superintendency of Banking, Insurance and AFP (SBS) advances towards the full regulation of Law No. 31143, a law that protects consumers of financial services from usury, through a project that seeks to end the inter-seat commission charged by ATM channels or service window in a location other than the city where the bank account was opened. The resolution, which is in the pre-publication phase, establishes that if the banks wish to make these charges, they will have to support the charges as services that, in effect, were provided, or generate an additional cost.
“Today in the market there are already regulations that are being applied. For instance, On the issue of interplaza, since the entry into force of the law, banks can no longer collect it. The SBS project also regulates the charges for evaluation, administration and management fees of an endorsed policy, in the case of credit life insurance, which is a condition for contracting a credit product.
“Nor can they charge commission for endorsement of policies when you bring private insurance. Until before the entry into force of the law, it represented a commission ”, clarified Carrillo Acosta.
It should be noted that, from now on, companies will also inform users of the compensatory interest rate and default interest rate in the event of non-compliance, as well as commissions and expenses associated with the different financial services.
