FOSE: official law that reduces electricity rates for low-income families

The Congress of the Republic made official the promulgation of Law No. 31429, which modifies articles 1, 2 and 3, and incorporates article 3-A in Law 27510, Law that creates the Electricity Social Compensation Fund (FOSE).

From now on, the FOSE will provide subsidies to those users who consume up to 140 KWh per month, and no longer up to 100 KWh/month, included within the low-voltage tariff options for residential use or those that subsequently replace them.

Likewise, it indicates that those residential users of collective supplies for block sales with average unit consumption less than or equal to 140 kWh/month are also considered, including low voltage electrical supplies, measured through a meter connected to medium voltage.

According to the new article 3-A, the supply delivery point benefiting from the FOSE discount must not be located in the blocks classified as high and medium-high strata, according to the stratified map available by blocks from the National Institute of Statistics and Informatics (INEI).

The modifications will be applied as of the price list for the month of January 2023, with the exception of the exclusion criteria mentioned in the previous paragraph for the delivery points located in the provinces other than Metropolitan Lima and Callao.

“Until December 31, 2022, the distributors of provinces other than Metropolitan Lima and Callao validate the cadastral plans of their users with the stratified plan available by INEI blocks,” the document clarifies.

With the validation, the aforementioned distributors proceed with the exclusion of the delivery points referred to in article 3-A, as of the price list for the month of January 2023.

Residential users of the electricity service with average consumption of up to 140 kWh/month during the twelve-month period ending in October of the year prior to the setting of the surcharge factor and transfer program indicated in the Text are also excluded. Only ordered by the FOSE, and greater than 140 kWh of average consumption during the months of the summer season included in the months of January, February and March of said annual period.
