One day before dismissal of Ruth Arregui as Superintendent of Banks, there were several changes and movements within the financial control entity. Thus, on February 21, in accordance with the decisions of the Intendant General of Institutional Management, Javier Bolaños Rojas, Rosa Matilde Guerrero, a trusted friend of the then Superintendent of Banks, Ruth Arregui, was appointed as Intendant General.. From what is known, as a rule, the person who assumes the position of superintendent in the absence of the incumbent is precisely the person who holds the position of general intendant.
Article 184 of the Financial Institutions Law indicates that, in the event that the post becomes vacant, the superintendent “will be subrogated, until the incumbent is appointed, by the general intendant; and in the absence of this, by the mayor with the greatest seniority in that function”.
Rosa Matilde Guerrero has a master’s degree in Economics and was an alternate director before the IDB for Ecuador.
The new appointment was confirmed the same February 21, when Bolaños left the appointment of Amparo Nataly Espinoza Zambrano unsubstantiated, who had been holding the position of general manager of the Superintendence. Likewise, the free removal appointment of Rosa Matilde Guerrero as adviser 2 of Arregui’s office was eliminated.
Subsequently, he was awarded position of mayor general to Guerrero, and the position of national mayor of Control of the Social Security System was granted to Espinoza.
For its part, the Association of Private Banks (Asobanca) said after hearing the decision of the Assembly: “We are respectful of the processes and actions of the functions of the State and we will wait for a new authority to be appointed. At Asobanca we believe that stability and institutionality in supervision and control entities are key to the country’s development”.
The now former superintendent was dismissed and censured in a political trial, despite the fact that in the first instance the Oversight Commission approved a report recommending filing it. Arregui had been prosecuted for eight reasons, which referred to alleged breach of duties by not sanctioning banks that would have charged illegal values to their clients during the pandemic; also for not having issued a sanction to Big Money in an agile manner and waiting for the Prosecutor’s Office to act.
Meanwhile, Arregui always maintained that he acted responsibly and in accordance with the law. She also considered that the political problem that existed was that they wanted to punish her for having contributed information to the issue of Isspol.
In the plenary session of the Assembly, on the other hand, the Audit report was ignored and censorship proceeded.
