Sunafil: companies with more than 20 workers must have a health and safety committee

The National Superintendence of Labor Inspection (Sunafil) Employers who have 20 or more workers are reminded of the obligation to set up a safety and health at work committee, which is made up of an equal number of representatives of the worker and the employer, and may not be less than four or greater than 12 members.

The committee is in charge of approving the company’s internal regulations and the annual occupational health and safety program. In addition, among other functions, it must ensure that workers are aware of the regulations, instructions, technical work specifications, notices and other written or graphic documents related to the prevention of risks in the workplace.

The committee also carries out periodic inspections of the workplace, such as the administrative and operational areas, facilities, machinery and equipment, reinforcing preventive management and, in the event of accidents and occupational diseases, considers the circumstances and investigates the causes, making recommendations to avoid that they repeat

In centers with less than 20 workers, they are the ones who choose a supervisor of safety and health at work. Both the committee or supervisor are elected through an electoral process for a period of at least one year and two at most, following the procedure approved by Ministerial Resolution No. 245-2021-TR. Not having them is a serious offense punishable by a fine.

Sunafil: accidents at work

Workers who consider that a safety and health violation has been committed at work can file a complaint with Sunafil so that the investigations can proceed.

In the event of non-fatal, minor or serious accidents, the employer must ensure the medical care of those affected. In the event of a fatal accident or a dangerous incident, it must be reported within 24 hours of the event occurring on the institutional portal of the Ministry of Labor and Employment Promotion.
