The Consumer Defense Commission of Congress unanimously approved the opinion of Bill 1061/2021-CR, which proposes that pharmaceutical companies inform on their labeling if the products requested by the client or offered alternatively are distributed or manufactured by a related company.
The text presented by congressman José Luna Morales of Podemos Peru, proposes that “the containers of pharmaceutical products that have been manufactured by a laboratory linked to the establishment where they are sold, must include the commercial name of the latter, in a visible space ”.
The autograph indicates that in this way it will benefit consumers “by establishing protection measures against bad commercial practices of pharmaceutical establishments, distributors and laboratories.”
During the support of the project, Luna Morales pointed out that currently two pharmacy chains concentrate 80% of drug sales in Peru. In addition, she emphasized that these companies “abuse their position of dominance.”
“In previous years they have already been fined by Indecopi for having discovered that they formed cartels to artificially increase drug prices,” he said.
He also cited the case of drugs, such as azithromycin, which rose exponentially in price during the first wave of COVID-19.
“The case of azithromycin, which in the generic version increased more than 12 times and went from costing S/ 3.00 to about S/ 50.00, while the brand name went from S/ 9.90 to S/ 132 average,” he commented.
The bill seeks to amend various articles of the General Health Law, the Law on Pharmaceutical Products, Medical Devices and Health Products, as well as the Pharmaceutical Chemist Work Law and Supreme Decree 014-2021, which establishes the regulations for establishments pharmacists.
The regulation of the law would fall to the General Directorate of Medicines, Supplies and Drugs, as the governing body for the sale of medicines in the country.
