Plenary: Project that regulates electronic commerce in Peru will be debated this Wednesday

This Wednesday the Plenary of Congress is scheduled to discuss the initiative relapsed into PL 398/2021-CR and 415/2021-CR with which it is proposed to modify Law 29571 (Consumer Protection and Defense Code).

It is worth mentioning that this opinion, promoted by the Podemos Peru group, has already been approved by the Consumer Defense Commission.

In essence, the 398/2021-CR project seeks to protect citizens from financial fraud through the consolidation of complaints in virtual windows, which will help the National Police of Peru in gathering information.

Said virtual window to prevent computer fraud will be compulsorily disclosed by the SBS, Indecopi, Osiptel, PNP and the financial entities supervised by the SBS.

While project 415/2021-CR, aims to add provisions that guarantee the protection of consumers of digital channels by modifying the Consumer Protection and Defense Code.

In this sense, the initiative determines that The intermediaries – the digital platforms – will be responsible for the delivery of the product as well as the suppliers.

To this is added the right of repentance, a power with which the consumer may terminate the contract in an eCommerce service or product without having to justify their decision and without penalty of any kind within a maximum period of 15 days.
