Osiptel begins sanctioning procedures against Movistar, Claro, Entel and Bitel

The Supervisory Body for Private Investment in Telecommunications (Osiptel) initiated an administrative sanctioning process against Movistar, Claro, Entel and Bitel after detecting that they continued to offer mobile service contracting at unreported points of sale, despite the provisions of current regulations.

The regulator reported that its Directorate of Inspection and Instruction found that both in Lima and in the provinces, companies continued to offer citizens mobile chips on the streets and contracting the service on public roads and points not authorized or reported to Osiptel.

In this sense, on December 30, 2021, Osiptel notified the four operating companies of the initiation of the sanctioning process, as well as the resolution of precautionary measures that order the termination of this contract within a maximum period of one business day.

Osiptel’s actions comply with the provisions of article 11-D of the Single Ordered Text (TUO) of the Conditions of Use of Public Telecommunications Services, which establish the contracting of services in authorized spaces and informed to the regulator, the same as they differ from the public thoroughfare or outpatient sale.

Risks of buying chips on the streets

According to Osiptel, the purchase of mobile chips on public roads can put users’ personal data at risk. In addition, it does not provide clear and detailed information about the contracted service.

“There is the possibility that the personal information and the user’s fingerprint is used for purposes other than those authorized and even in fraudulent activities or other crimes,” he adds.
