Doe Run Peru: Payment to Minera Company Ex -workers

After approving the continuity of A-1 consultants as a liquidator of the assets of the company Doe Run Peru, a new entrepreneur could delay the payment of the debt to the extrabajadores. According to this media, Luis Mantari, representative of the labor creditors, the ratification of the validity of the liquidation agreement approved in March 2022 has been questioned by Doe Run Cayman and mining chemical deposits (DQM).

And it is that according to both companies a new treaty must be subscribed because A-1 consultants He lost the validity of his registration as a bankruptcy administrator in December 2024. However, the last February 21 of this year a vote was held at the meeting of the Board of Creditors obtaining as a result 64% of the assistant credits, which was observed by Indecopi because it did not reach a qualified majority of 67.7%:

“In literal C of article 92 of the regulations of the bankruptcy system it is established that a new agreement is not necessary. So, when a liquidator loses its registration, it does not tell you that you must change it or make a new one. In this private board of February 21, the representative of Indecopi was as a veedora and said that the ratification of the agreement had not approved because it had to be a qualified vote of 67.7%,” Mantari explained.

Prior to that session of the Board of Creditors, there was an advance of opinion by the Indecopi official that does not proceed a ratification, but to make a new liquidation agreement. This argument was used by Doe Run Cayman and DQMwho took that and presented an appeal for nullity.

For Mantari, it is curious that the 2022 agreement has been ratified by both companies with a 94%vote, while now, they use as a support the need to sign a new treaty because Consultores A-1 lost its registration, which was recovered on January 8 of this year. Given this controversy, the former worders have sent a series of notarial letters requesting the pronouncement of INDECOPI to accelerate the resolution of this entrepreneur.

The ball is on the court INDECOPI Bankruptcy Procedures Commission that would be solving this controversy in 30 days. However, Luis Mantari expresses his little optimism about the decision made by the entity and announces that the former Doe Run Peru will travel to Lima to perform a mobilization next Tuesday, March 11.

“Faced with this situation, the workers have decided to travel to the city of Lima to carry out a protest in front of the Headquarters of Indecopi. We ask Indecopi officials to solve the controversy and act according to the legality. The payment of the labor debt should already have been resolved several years ago. We are only claiming something fair,” said Mantari.

Nearly 3,500 workers and their families are in the expectation of the resolution of the US $ 19.41 million trustee that are in a bank account in Scotiabank. As remembered, more than 12 years have passed and the liquidation process of Doe Run enters its final stage to set out with the pending environmental and labor commitments.
