A student of the Peruvian University of Applied Sciences (UPC) denounced this house of studies before INDECOPIafter being expelled for alleged plagiarism in a Placement Test of the Language Center. The affected young woman assured that the institution would have applied an incorrect regulation for her punishment, thus violating her rights as a consumer.
Although the UPC argued that, according to its academic regulations, the expulsion of the young woman was justified by the alleged plagiarism, the student indicated that such evaluation belonged to the University Language Center. Therefore, the sanction should not be governed by the General Academic Regulation, but by the specific norms of the Language Institute.
What was the sanction that INDECOPI provided to the UPC?
After the corresponding evaluations, the National Institute for the Defense of Competition and the Protection of Intellectual Property (INDECOPI) determined that the expulsion of the young student did not adjust to the corresponding norms of the UPC, affecting their rights and violating the principle of suitability in education.
Although it was confirmed that there was plagiarism by the young woman in the process of evaluation of the Placement Test of the Language Center of the UPC, the University applied an inappropriate regulation to sanction the student, so that the expulsion was not adjusted with said standards.
Given this, INDECOPI ordered the immediate reinstatement of the student to the educational center of higher level so that he can continue with his academic training. It also imposed a fine to the UPC of an ITU (Tax Tax Unit), that is, S/5,350 (current amount) for breaching the Consumer Protection and Defense Code.

As specified on the official website of the UPC, the monthly payment that must be paid depends on the career that the student chooses and the category. For example, in the case of civil engineering and law specialties, the monthly category is S/4.583; while the pension for the lowest category is S/1,517 and S/1.947, respectively.
