What happened? In April of this year, the Directorate of Inspection and Instruction (DFI) of Osiptel informed Telefónica of the start of an administrative sanctioning procedure (PAS) for not having fulfilled 23,814 requests for migration of the tariff plan for fixed internet access services or services packaged with said service.
According to Osiptel, this procedure should have been carried out within a maximum period of “one (1) business day if a visit is not required and up to five (5) business days if a technical visit is required”, for the period between April 5 and May 28, 2021.
On the other hand, Telefónica would not have made effective 7,859 requests to cancel the services that contain the Fixed Internet component, “within the maximum period of one (1) business day, in the period between April 5 and May 28, 2021.”
On May 9, 2024, Telefónica submitted its defense by letter No. TDP-1756-AR-ADR-24. Five days later, the Final Investigation Report was issued and on June 11 of this year, the fine amounting to two sanctions of 150 UIT each was determined.
On July 2, 2024, by letter No. TDP2613-AG-ADR-24, the Spanish capital company filed an appeal and today, Wednesday, July 17, the Osiptel Court of Appeals ratified the amount imposed. Telefónica could still take the debt to court.
