Workers will receive an extraordinary bonus equivalent to 9% or 6.75% of their salary, depending on whether they are affiliated with EsSalud or an EPS.
This Monday, July 15, is the deadline for companies in the private sector to deposit the Fiestas Patrias bonus to their workers. According to the law, if the company does not comply with this, it would be forced to pay a fine of up to S/134,518.
“The lack of full and timely payment of this benefit is one of the most recurrent breaches and It involves the commission of a serious violation in labor matters, with a possible fine for the non-MSE employer of between S/8,085.50 and S/134,518depending on the number of affected workers and the amount of the current UIT,” explains Mauricio Matos, partner in the labor area of EY Peru.
Workers who worked from January to June will receive a monthly salary. Meanwhile, those who worked more than one month in that same period, but less than six months, will receive a proportional amount according to the months actually worked in that period.
On the other hand, workers of small companies, hired after the company was registered in the Registry of Micro and Small Enterprises (Remype), will receive half a salary as a bonus.
Besides, The 9% of the bonus amount that, as an employer, will no longer be contributed to EsSalud must be taken into account. This must be given to the employee as an extraordinary bonus. Thus, if an employee is affiliated with EsSalud, he or she will receive an extraordinary bonus of 9% on the computable remuneration. If you are affiliated with a Health Provider Entity (EPS), you will receive a bonus of 6.75%.
