All about the July 2024 bonus: find out the amount, who receives it and when they pay

The gratification is a right that benefits private sector workers in Peru, granting additional income in the months of July and December. This payment, regulated by Law No. 27735, aims to support employees during the National Holidays and Christmas, respectively. By July 2024, employers are expected to fulfill this commitment, providing not only the amount corresponding to the salary, but also an extraordinary bonus of 9%, exempt from contributions to EsSalud.

July 2024 bonus: who receives it?

Private sector workers, both full-time and part-time, are entitled to receive the bonus if they have worked at least one month in the six-month period prior to July 15. This includes employees of micro-enterprises, although the calculation may vary. However, public sector trainees and employees are excluded, as they have specific regulations for their bonuses and allowances, different from the Private Sector Bonus Law.

When do they give the bonus?

The July bonus must be paid no later than July 15 of each year. This deadline is mandatory for employers, who must comply with the deposit of this benefit in their employees’ accounts before this date. Failure to comply with this deadline may result in sanctions for companies, highlighting the importance of being well informed and demanding this right in time.

To calculate the gratificationthe gross monthly salary of the employee must be considered. If the employee has worked for the entire semester, he/she will receive the equivalent of a full salary. If he/she has worked less than six months, a proportion of the salary is calculated for each month worked. Additionally, an extraordinary bonus of 9% of the amount of the gratuity is granted, which is exempt from contributions to EsSalud and is deposited together with the gratuity.

For example, if your salary is S/2,000 and you have worked the entire semester, you will receive S/2,000 plus a bonus of S/180, totaling S/2,180. This calculation is essential to ensure that workers receive the correct amount and avoid potential labor disputes. What happens if I am not paid the bonus?

The payment of the bonus is stipulated by law, so failure to pay it within the established period constitutes an infraction. Companies that do not make the appropriate payment may be sanctioned with fines that vary according to their category. In the case of a small company, the fine ranges between S/2,227 and S/22,275. For a company not considered an MYPE, the fine can reach up to S/129,294.

Penalties for non-compliance are intended to ensure that employers comply with their obligations and that workers receive their benefits on time. It is crucial that employees know their rights and the steps to follow if they do not receive the corresponding payment, including the possibility of filing complaints with the competent labor authorities.

Who does NOT receive gratuity?

The bonus is a right for all public and private sector employees, including those with fixed-term, temporary or indefinite contracts. It does not apply to independent or non-payroll workers. Those who have worked at least one month between January and June 2024 are entitled to receive the July bonus.
