According to the Lima Chamber of Commerce (CCL), workers in the private regime who work during the June 29 holiday and do not agree with their employer on a replacement date for their respective rest, will have to receive a triple payment that includes the following concepts :
- A remuneration corresponding to the holiday (included in the monthly salary).
- A remuneration for the work done.
- A 100% surcharge corresponding to the work performed.
“The work carried out on Saturday, June 29, without substitute rest, gives rise to the payment of the corresponding remuneration for the work carried out, with a 100% surcharge,” explained Álvaro Gálvez, manager of the CCL Legal Center.
Likewise, he indicated that since the holiday on Saturday, June 29 falls on a weekly rest day, the worker will only receive remuneration for the weekly rest and not for the holiday. “In addition, it is not considered that work has been done on a holiday when the work shift begins on a workday and ends on a holiday,” he added.
Let’s take an example: if a worker earns the minimum wage of S/1,025, the daily amount will be S/34.17 after dividing his salary by 30 days. In this sense, your payment must consider the sum of the holiday that is already included in your monthly remuneration (S/34.17), for the work performed (S/34.17) and the 100% surcharge corresponding to the work performed (S/34.17).
