The Ministry of Energy and Mines (Minem) approved to modify the definitive concession to develop the activity of generating electricity with renewable energy resources of the solar power plant “CSF Continua Misti 300 MW” in charge of the company CSF Continua Misti SAC located in Mollendo (Arequipa), for its start on 14 October 2022. In addition, they described as “force majeure” the supply problems exposed by it.
The Peruvian company CSF Continua Misti SAC- dedicated to the generation, transmission and distribution of electrical energy- had presented problems in the cadena supply of solar panels, due to the COVID-19 pandemic, which affected compliance with the works execution schedule, which should be operational on December 23, 2021, according to the resolution.

It should be noted that, according to Article 36 of Decree Law No. 25844, Electricity Concessions Law, it says that if “the concessionaire does not comply with the execution of the works according to the Works Execution Schedule, unless it shows that the execution has been impeded by the occurrence of fortuitous event or force majeure qualified as such by the Ministry of Energy and Mines ”, the concession expires.
However, the supply problems caused by COVID-19 alleged by the company CSF Continua Misti SAC were considered as “force majeure”, which is why they approved the first modification of the definitive concession to change the start date of the civil works to October 14, 2022.
