This initiative’s main objective is to ensure transparency in commercial transactions and safeguard the rights of consumers, giving them the possibility of making purchases in an informed and conscious manner.

“In the event that the supplier differentiates the price of the product or service based on the payment method, such as Credit cards or others, said information must be made known to the consumer, prominently, in a visible and accessible manner in the premises or commercial establishment through posters, notices or other similar. In the event of non-compliance by the supplier, consumers cannot be forced to pay additional sums, and the price set for the product or service must be respected,” establishes the Article 7 of the Consumer Protection and Defense Code.

Indecopi: how much would the fine be if the company does not notify the extra charge with the card payment?

According to current regulations, the National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) has the power to impose fines on commercial establishments that do not provide clear and timely information on additional charges for the use of credit cards. The sanctions imposed by Indecopi can range from a simple reprimand to reaching the figure of S/2 million 70,000 (equivalent to 450 Tax Tax Units, UIT).
