Indecopi orders Rappi to consult consumer tip payments and not place the amount automatically

Attention Rappi user! The Specialized Consumer Protection Room (SPC) of Indecopi has issued a statement in which it indicates that the delivery company Rappi SAC has been found in violation of consumer rights by automatically establishing the delivery of tips.

This practice, considered abusive by the company, has generated controversy among the thousands of users of the platform, who have been affected by this imposition. The SPC has urged rappi to correct this situation and respect consumer rights, guaranteeing a fair and transparent transaction for all parties involved.

Ordinance warns that company limited the consumer to free choice

Through the Resolution 1235-2024/SPC-INDECOPI published this May 6, 2024, the Consumer Protection Room (SPC) argued that the conduct described qualified as a coercive commercial method, by forcing the consumer to assume an unagreed benefit, which constitutes a violation according to article 56.1 literal b) of the Consumer Protection and Defense Code. Likewise, the resolution indicates that the preselection of an amount for tip in the application rappi It limited the consumer’s ability to freely choose whether or not to tip.

Along these lines, this measure confirmed the administrative responsibility on the part of the renowned delivery company contained in Resolution 0043-2023/CC3 of June 20, 2023, which was issued in the first instance by the Consumer Protection Commission No. 3, which was initially appealed by the company. These types of practices violate consumer rights by restricting their freedom of choice and affecting their decision-making capacity in the purchasing process.

As established by Indecopi, the Consumer Protection and Defense Code points out that commercial establishments that apply a surcharge for the use of credit cards are obliged to inform consumers immediately upon entering the premises.

This measure seeks to guarantee transparency in commercial transactions and protect the rights of consumers, who must be duly informed about any additional charges they may incur when making purchases with a credit card. It is essential that businesses comply with this provision to avoid possible conflicts with customers and promote a relationship of trust and respect in the commercial field, in addition to the fine that could reach up to S/2 million 70,000 (450 UIT).
