Indecopi confirms sanction to Juan Luis Guerra concert organizers for overselling tickets

Sanctioned! The Chamber Specialized in Consumer Protection Indecopi (SPC) has confirmed the sanctions imposed on the company Fans & Music Entertainment SAC and its general manager, responsible for the organization of concerts by the renowned artist Juan Luis Guerracarried out on November 22 and 23, 2022. This decision ratifies the total fine of 362.5 UIT imposed and the obligation to return the money to consumers affected by said events.

Along these lines, according to resolution 1041-2024/SPC-appeal established on April 15, 2024, the SPC confirmed in the second and final instance the ruling of the Consumer Protection Commission No. 3, which sanctioned Fans & Music Entertainment SAC for overselling various tickets for the concerts on November 22, 2022.

Why were they sanctioned?

The sanction was due to the fact that the company organizing the event put 13,814 tickets on sale, despite being authorized a maximum capacity of 9,000. This action had an impact on several consumers, who could not enter the concert due to the full capacity, for which they were first fined 3.2 UIT.

In addition, they were sanctioned again because they did not perform the show on the established date on November 23 and gave notice minutes before the time established for the concert, for which a 53.6 UIT fine was applied to them.

Sanction for the general manager of the organizer

The sanction that ratifies the Indecopi It also affects the general manager of the organizer, Juan de Dios Guevara Riglos, for having acted jointly and with inexcusable guilt in the face of the sanctions imposed, for which a fine of 5 UIT is applied.

The district municipality of Santiago de Surco, at the time, closed the premises Peru Arena, place where the concert of the Dominican artist, Juan Luis Guerra, was going to take place. The annoyance on the part of the attendees at that time was evident, because many had bought their tickets in advance and could not enter.
