The debate on the withdrawal of up to 4 UITs from the Pension Fund Administrators (AFP) will take place this Thursday, April 11, in the Plenary Session of Congress. This decision was adopted unanimously in the last session of the Board of Spokespersons after collecting the request from the spokespersons of the benches that support a new disbursement of the individual capitalization accounts.

However, for the opinion of the Economy Commission—chaired by parliamentarian César Revilla—to be approved in the assembly of the Legislative Branch, a number of votes stipulated in the regulations are required. “Agreements are made with the vote of the simple majority of all the members present at the time of the vote, including the vote of the President. In the event of a tie in the vote, the President will have a casting vote,” reads in the document.

This means that, since it is not an organic law or a budgetary norm, it can only be approved with the majority of congressmen who attend the day of the Plenary session.

What did the congressmen say about the AFP withdrawal debate in the Plenary?

One of the first congressmen to speak out, after the decision of the Board of Spokespersons to include in the Plenary agenda the opinion of AFP withdrawal of up to 4 UITs, was José Luna, from Podemos. According to the parliamentarian, there are the necessary votes to approve this proposal, although he hopes to obtain broader support.

“I have been able to talk with other parties, there is a will to approve it. There are only a couple of parties left to join. That is what I am going to dedicate myself to now. These resources that would come out of the pension funds will help Peruvians pay their debts, cover the basic needs of their families and even to invest in a small business,” he said.

For his part, the non-grouped congressman Guido Bellido welcomed, in his X account, the decision of the Board of Spokespersons to schedule the debate and vote on the disbursement of private pension funds. “Let’s go with everything, the country needs to reactivate its economy. Promise kept up to this stage,” he wrote.

Finally, parliamentarian Wilson Soto highlighted the importance of “the population having their savings” and that actions to promote financial culture be promoted to use those funds responsibly.

What is missing for the AFP withdrawal to be approved?

The ruling that authorizes the optional withdrawal of up to 4 UIT (S/20,600) must be debated this Thursday, April 11, in the Plenary Session of the Congress of the Republic. Once the legislative initiative is approved in this instance, the signature of the law must be sent to the Executive Branch, which could observe it or authorize its publication in the newspaper El Peruano.
