Ositrán fined S / 10 million to concession companies for breaching contracts

Through a press release, the Supervisory Agency for Investment in Transportation Infrastructure for Public Use (Ositran) reported that between January and December 2021 it applied sanctions and penalties for a total amount of S/ 10 million 90,047 to various concession companies.

In compliance with its supervisory and sanctioning function, the regulatory entity indicated that a total of 13 penalties were imposed, two to Andean Airports of Peru for S / 4 million 10,000 for environmental breaches and six to Airports of Peru for S / 381,082 for breaches of its Regulations for the Execution and Contracting of Works, the non-maintenance of the concession assets and the untimely presentation of invoices for payment fees for infrastructure modernization.

Likewise, Ositrán indicated that two penalties were applied to the Sierra Norte Road Concessionaire (Convial) for a total of S / 4 million 89,000 soles for not raising the observations to a technical file within the established period and having submitted an extemporaneous environmental report.

For its part, the company Ferrocarril Transandino received a warning penalty for sending the update of annex 2 of its concession contract out of time, with information related to the registry of concession assets.

The company Concesión Canchaque was awarded a penalty of S / 1,600 for the late submission of a monthly road maintenance report and the Concesionaria Vial del Perú a penalty of S / 69,129 for not completing maintenance work on the road in the established deadlines.

Of the sanctions imposed that have a firm resolution from the regulator, four were applied to the concessionaire Tren Urbano de Lima (Line 1 of the Lima Metro) for the sum of S / 484,484 due to obstruction of supervision activities, non-observance of safety regulations , inoperability of fire fighting systems and refusal to submit information.

Two fines for a total of S / 43,868 fell on the concessionaire Lima Airport Partners (Jorge Chávez International Airport) for breaches related to access to the infrastructure and a fine to Corpac that was sanctioned with S / 79,508 for not complying with the maintenance of the concession assets and not informing users of temporary alterations or emergency situations.

In the port sector, sanctions were applied to the company Terminal Portuario Paracas (General San Martín Port Terminal) for S / 2,772 and APM Terminals Callao (Terminal Muelle Norte) for S / 28,644 as a result of breaches of the service levels agreed in the respective contracts concession.
