The official, who began his administration on August 26, assured that the consultations made by the previous regime to the Attorney General’s Office, in October 2020, and to the Ministry of Labor, in March 2021, exempt from responsibility for the payment of the debts of the seized private companies, to the company holding their shares, that is, the Public Communication Company of Ecuador EP.

In the case of the Attorney General’s Office, Roldós assured that the entity ruled: “(…) a public company that is a shareholder of private companies, as is the case of Public Media EP in liquidation, is excluded from employer solidarity, in accordance with the tenor of the third paragraph of article 36 of the Labor Code, in accordance with article 143 of the Companies Law ”.

Meanwhile, the Ministry of Labor argued that “the employment relationship between the employer and its workers is independent and does not extend to its shareholders, consequently the Public Communication Company of Ecuador EP is not the employer of any worker of the companies of the who is a shareholder ”.
