The Supervisory Body for Private Investment in Telecommunications (Osiptel) confirmed 14 fines for a combined value of S/5 million 960,790 against the company Telefónica del Perú, for having failed to comply with the minimum Internet speed in the same number of population centers in Peru in the year 2022.
The resolution of the Board of Directors No. 00090-2024-CD/OSIPTEL, published this Friday, March 29, confirms the 14 fines imposed a year ago by the regulatory body through General Management resolution No. 433-2023-GG/OSIPTEL.
In detail, there are 9 fines for 1,065.2 UIT (S/5 million 272,740) and 5 fines for 139 UIT (S/688,050) imposed in December 2023 for having failed, during the first half of 2022, to reach the objective value of the “Minimum Speed Compliance (CVM)” indicator corresponding to the mobile internet access service for the download speed (DL) in 3G and/or 4G technologies in 14 population centers. The process had begun in May.
Telefónica filed an appeal for reconsideration of the million-dollar fine on January 16, 2024, which was taken by Osiptel as an appeal. However, he did not present new evidence in his defense, and rather considered that his new arguments were “discriminatory.”
Finally, the Peruvian regulatory body decided to declare the appeal unfounded and, in this way, ratify the 14 fines of S/5 million 960,790 against Telefónica.
