Easter holidays: how much should they pay you if you work on Thursday, March 28 and Friday, March 29?

Check the amount you should earn if you work on a holiday, according to what Legislative Decree No. 713 indicates.

As the Easter holidays approach, many people are organizing trips or activities with their families and loved ones to take advantage of the long weekend. However, there are those who have to continue working on Thursday, March 28 and Friday, March 29, even though they are national holidays.

As established in legislative decree No. 713, employees, both in the private and public sectors, who work on days designated as holidays have the right to receive up to three times their normal salary or to enjoy a day of compensatory rest.

How much will I receive if I work on a holiday during Easter?

To explain it better, the Lima Chamber of Commerce (CCL) offers a practical example. Let’s say an employee earns S/3,000 a month, which means his daily salary is S/100 (3,000 divided by 30 days). If he works this Thursday or next Friday, without a day of compensatory rest, his pay must be calculated as follows:

  1. For the holiday, which is already included in your monthly salary, you will receive S/100.
  2. For the work done that day, you will be paid another S/100.
  3. In addition, you will receive a surcharge of 100% of your daily salary, equivalent to another S/100.

In total, the employee will receive S/3,200 that month, since the S/200 corresponding to work on those holidays will be added.

How are payments determined on holidays?

Álvaro Gálvez, manager of the Legal Center of the Lima Chamber of Commerce (CCL), pointed out different scenarios to take into account:

  1. Paid holidays: National holidays, such as April 6 and 7, are paid for both public and private sector workers, without the need to work for the employer.
  2. Work on holidays without substitute rest: private sector employees who agree to work on these days, without a subsequent day of compensatory rest, must receive triple payment for the holiday: one for the day off and another for working on a holiday with an extra 100%.
  3. Work on holidays with substitute rest: if it is agreed to work on a holiday with the possibility of obtaining a day of rest afterwards, the payment will be normal.
  4. Remote work on holidays: Employees who work remotely also have the right to the holiday and to receive their salary without working. If it is agreed to work on the holiday without a compensatory day of rest, they will also be paid triple.
  5. Medical rest during the holiday: if a worker is on medical rest during a holiday, they will receive payment for it without working. If the medical leave begins after the 21st day of the holiday, the employer will pay the holiday as an allowance, not as additional remuneration.
  6. Vacation during holidays: Workers who are on vacation during a holiday will not receive additional pay, since the holiday is included in their vacation compensation.

What days does Easter fall?

In the year 2024, the Easter It will be held on the following dates:

  • Palm Sunday: March 24th
  • Holy Thursday: 28th March
  • Holy Friday: March 29
  • Holy Saturday: March 30th
  • Easter Sunday: March 31st.
