The National Port Authority (APN) has filed a contentious administrative lawsuit before the public attorney’s office of the Ministry of Transport and Communications (MTC) to annul the exclusivity of the exploitation of essential services that the Cosco Shopping company will have over the Chancay Megaport.
According to information disclosed by Latina, the port authority assures that the exclusivity of the Chinese-owned company is carried out through an administrative procedure for granting the right to use an aquatic area that does not constitute “a contractual commitment signed by the Peruvian State with the private sector”.
As recalled, the first stage of the Chancay Megaport, which must be completed next November for the APEC 2024 summit, requires a purely private investment of US$1.3 billion, and is at a level of progress close to 80%.
However, for the APN, said exclusivity, which will turn Peru into a commercial hub in South America, “was granted for a case not regulated by the National Port System Law or its Regulations, through a Directory Agreement.”
“Without taking into account that exclusive port exploitation is provided only in cases where there is a contractual commitment signed by the Peruvian State with the private sector. […] With such granting, free competition in the execution and provision of port activities and services is limited or broken,” the file states today in the Tenth Permanent Court of Lima.
Both the company Cosco Shipping – which is in charge, by current contract, of the construction and operation of the Chancay Megaport – and the APN and the MTC, have not issued a statement so far.
