The congressman of the Democratic Change Caucus–Together for Peru Edgard Reymundo presented Bill 7326/2023-CR that promotes equal labor rights for workers hired under the CAS regime. Through this initiative, measures are proposed so that they receive bonuses, gratuities, CTS and other social benefits.

Let us remember that on January 23, the Labor and Social Security Commission approved an opinion to make modifications to Legislative Decree 1057 (CAS) and, in this way, employees enjoy more rights. Below, learn about all the scope of Edgard Reymundo’s legislative proposal.

CAS workers will be able to receive CTS and other benefits: what is the project about?

According to the explanatory memorandum of Bill 7326/2023-CR presented by parliamentarian Edgard Reymundo last Friday, March 15, the CAS regime is precarious, unstable and generates a situation of uncertainty by not being able to organize a life plan in favor of from the workers. Furthermore, he states that remunerations are offered below S / 2,000 and the right to a CTS, productivity bonuses and other social benefits is not guaranteed.

“The Executive issued various emergency decrees allowing the hiring of CAS workers, but for a certain time, recognizing and granting little by little the right to permanence to this regime; however, it is at a disadvantage with respect to other regimes in the same public sector. , which have more complete social benefits and which, technically, should also have their corresponding remuneration scale in accordance with the Civil Service Law and position classifier, so it is necessary to grant stability to said workers.”, it reads. in the PL.

With the objective of promoting equal rights of workers hired under Legislative Decree 1057, it is proposed to incorporate new subsections in article 6 of this regulation that allow access to:

  • Bonus for schooling.
  • Reward for National Holidays and Christmas.
  • Household allowance.
  • Inclusion in the remuneration scale.
  • Allowance for years of service, equivalent to 2 monthly salaries upon completing 25 years of service and, if reaching 30 years of service, it will be 3 salaries.
  • Compensation for length of service.
  • Subsidy for funeral expenses.

Likewise, article 3 of this legislative proposal specifies that the Executive Branch will adopt budgetary measures to comply with this norm. In the case of the rights recognized in article 2, they will be financed from the institutional budget of each entity, without demanding additional resources from the public treasury.

Labor Commission has ready an opinion to grant benefits to CAS workers

Last Tuesday, January 23, the majority of members of the Labor and Social Security Commission, chaired by Congressman Pasión Dávila, approved an opinion to expand the rights of workers in the special regime for Administrative Contracting of Services (CAS). In accordance with the standard that is based on legislative initiatives 2290/2021-CR and 6234/2023-CRarticle 6 of Legislative Decree 1057 is modified and employees are granted the following rights:

  • Access a career path that allows you to advance within your workplace.
  • Remuneration scale.
  • Rest or leave for birthdays.

It is worth mentioning that the debate on the same issue is pending in the Congressional Budget Commission before the opinion of the Labor Commission can be discussed in the Plenary.

What is the CAS regime?

The special CAS regime came into force on June 29, 2008 as a special contracting modality that sought to solve the problem caused by the proliferation of non-personal services (SNP) in the public sphere. So, its application occurs only in state agencies.

It is not under the public career regime (Legislative Decree No. 276) nor that of private activity (no. 728), but by Legislative Decree no. 1057, its regulations and Law no. 29849.
