During the first 30 days of the entry into force of Law No. 31557, which Regulates the Exploitation of Remote Gaming and Remote Sports Betting, 145 authorization requests have been submitted by national and international companies to participate in this activity.
144 linked service providers were also registered and 7 international certification laboratories were accredited. Suppliers have submitted 184 applications for approval of technological platforms, gaming programs, progressive systems and gaming modalities.
“These companies submitted their request to formalize and obtain the corresponding authorization to continue operating in Peru, a clear sign that the regulation of this activity has been successful,” said the head of Foreign Trade and Tourism, Juan Carlos Matthews.
Mincetur hopes that the entry into force of Law No. 31557 and its regulations will provide security to the player with responsible gaming policies, as well as the formalization of the activity for a regulated economic movement with payment of taxes. It is estimated that the volume of bets made in Peru during 2022 was close to S/3.8 billion.
“This is an important step that Peru is taking to regulate this activity, not only because of the economic movement it generates and the revenue it will have, also because of the need to provide security to citizens who enter and use these applications,” commented Mathews.
Mincetur: betting houses will contribute to the Pan American Games
On March 13, authorization requests were closed for those companies that had been operating before the entry into force of the Law. It is estimated that, by virtue of this rule, the State will be able to collect close to S/162 million annually.
Those companies that continue to offer this type of service and are not authorized will be subject to a fine of no less than 150 UIT, and also a criminal complaint and disqualification from carrying out this activity.
20% of the income from the tax on remote sports betting and games constitutes income for the promotion and massification of sports at the national level (more income for the IPD), which will strengthen national sports for the Pan American Games Lima – 2027.
The device determines that only natural persons of legal age, of Peruvian or foreign nationality, previously registered on the technological platforms of authorized remote sports betting or games, can participate in this activity.
“In the case of remote sports betting gaming rooms, these may be located in a location exclusive to this activity or others whose main purpose is the sale of other products or services,” the document states.
Mincetur: players will be able to collect bets in banks
Regarding betting, the new law indicates that the player must pay for his bets with currency, credit cards, debit cards or any other means of payment, with the exception of cryptocurrencies.
It is important to specify that authorized companies as of April 1 will be subject to the tax on games and remote sports betting, of 12% on their income. The money won as a prize will be collected in full. The tax will apply only to companies.
Furthermore, in the case of obtaining prizes, these may be collected by the payment method that the player chooses or, failing that, through an account in their name, opened in a company in the financial system under the supervision of the SBS.
It should be noted that only those sporting events that are part of national or international associations, federations or sports leagues can be the subject of sports betting.
