Osiptel confirms a fine of more than S/1.7 million against Entel for selling chips on the street

The Supervisory Body for Private Investment in Telecommunications (Osiptel) confirmed a fine of S/1 million 732,500 (350 UIT of 2023) against the company Entel, for not having ceased, in 2022, the contracting of the public mobile service (chips) at points sales not reported to that organization.

The resolution of the board of directors No. 00071-2024-CD/OSIPTEL, published this Friday in the official newspaper El Peruano, declares unfounded the appeal filed by Entel against General Management Resolution No. 191-2023-GG/OSIPTEL, which He previously imposed the fine.

According to this ruling, issued on April 12, 2023, “Entel did not stop contracting mobile public services at points not reported to Osiptel, such as at points of sale located on public roads and/or on an outpatient basis” .

“It is appropriate to keep in mind that there were previous coordinations with Entel since 2019, verifying from Report No. 092-GPSU/2019 that there was concern on the part of this organization regarding the commercialization of mobile service lines that had not been carried out at the points authorized as such, but, on the contrary, it was carried out on an outpatient basis on public roads,” the ruling states.

The start of the administrative sanctioning procedure (PAS) against the technology and telecommunications company, which operates in Chile and Peru, occurred in October 2022 for the alleged commission of the infraction classified in article 28 of the General Regulation of Infractions and Sanctions ( RGIS).

“However, since 2019 Entel continued to contract public mobile service through contracting channels not provided for by current regulations, resulting in the imposition of Precautionary Measures of a similar nature – such as the one evaluated in this PAS -; not being the operating company was diligent in adopting the corresponding measures in order to reverse this situation,” Osiptel says.
