The Economy, Banking, Finance and Financial Intelligence Commission convened a fifth extraordinary session for this Wednesday, March 13 at 10 am, with the purpose of debating the prediction of the law to modernize the Peruvian pension system, which it considers this time the withdrawal of up to 4 UIT (S/20,600) from the Pension Fund Administrators (AFP).
Unlike the previous proposal that was presented on December 12 of last year, this time a targeted withdrawal of up to 2 UIT is no longer included. According to the thirteenth final complementary provision, those who may have extraordinary access to the disbursement of funds of up to 4 UIT are those affiliates who do not have accreditation of contributions during the last six consecutive months until November 30, 2023.
“Affiliates of the Private Pension Fund Administration System who, until November 30, 2023, do not have accreditation of pension contributions to the individual capitalization account (CIC), for at least six consecutive months, are authorized in an extraordinary manner. to optionally withdraw up to four tax units (UIT) from the total funds accumulated in said account,” reads the opinion of the Commission chaired by César Revilla.
Likewise, it is indicated that this provision applies until the withdrawal is equivalent to 95% of what was contributed by the affiliate, specifying that the remaining 5% will be transferred directly to EsSalud by the corresponding AFP. To this, we must add that members who qualify to access the Early Retirement Regime for Unemployment (REJA) will not be able to request the disbursement of funds.
Finally, the sixteenth complementary provision of the opinion provides for the release of up to 2 UIT (S/10,300) in a single withdrawal from the capitalization account of affiliates who suffer from an oncological disease diagnosed by an institution providing health services, which must have the respective health authorization.
Withdrawal of AFP funds: what is the procedure?
The fourteenth complementary provision of the opinion of the Economy Commission establishes the following in relation to the request and withdrawal of funds:
- Affiliates submit their request virtually or in person and only once within ninety calendar days after the publication of the regulations of the law.
- An amount of up to 1 UIT is paid every 30 days, with the first disbursement made 30 days after the application is submitted to the AFP to which the affiliate belongs.
- In the event that the member wishes to stop withdrawing funds from their CIC, they can request it only once from the AFP, ten days before the next disbursement.
- The Superintendency of Banking, Insurance and Private Pension Fund Administrators (SBS) establishes the schedule to request the optional withdrawal, according to the last digit of the DNI, at a rate of one digit per business day in the first tranche. Afterwards, any member may submit their request without restriction on any business day.
