In two weeks the increase in the minimum wage will be discussed

The Minister of Labor and Employment Promotion, Betssy Chavez, announced for La República that the expected debate for an eventual increase in the minimum vital remuneration (RMV) will take place during the first week of January, within the framework of the next meeting called by the National Labor Council (CNT).

Although he did not give details of how much the tentative proposal for the minimum wage would be, Chávez Chino guaranteed that any increase will obey technical criteria that will be discussed in the group that was reinstated on November 13. It should be noted that in Peru there is already a formula for this calculation, but it has not been fully used since its creation, but rather for political interests.

“We are going to discuss (the RMV) issue the first week of January. And there will be a technical proposal that is still going to be worked on at the MTPE level. What we do indicate is that the increase in minimum remuneration should not be due to a moment of political emotion but to technical criteria, within the framework of the CNT ”, precise.

Labor Code comes out in May

On the other hand, the minister assured that the draft of the Labor Code will be presented to the Congress of the Republic in May 2022. In this line, she explained that, just as there are codes in civil and criminal matters, the idea of a simile for workers would allow the concentration of labor rights regulations, such as the one corresponding to the delivery of vacations and CTS, in a transversal way to the different regimes of the country.

“All this will be in a single normative body, that there is not so much dispersion of the norm. That there be principles that allow us to exercise the defense of the worker, of course with full respect for the employers, ”said the minister.

In addition, He stressed that this preliminary draft proposal is designed in line with the contributions of the different trade union centrals and employers that accompany the MTPE at the CNT table, in order to find coincidences in the regulations that may favor both private and public sector workers.

Benefits to CAS

Betssy Chávez also referred to the publication of the decision of the constitutional Court (TC) to declare, by majority, the unconstitutionality of Law 31131, which provided for the incorporation of workers with Administrative Services Contract (CAS) to labor regimes 276 and 728.

In this regard, the minister assured that from Executive power will respect the decision of the TC, for which a counterproposal is already being prepared at the level of the Presidency of the Council of Ministers (PCM), in which the observations will be collected in order to do justice to these workers who occupy approximately 20 % of the public sector payroll

“If I hoped that the underlying issue could be addressed: the situation of the CAS. Because right now you can’t fire yourself, but you can’t give the benefits that everyone would like. There is a very ambiguous situation, that is why we have to be very cautious when presenting this proposal, so that it ultimately benefits the entire working class under this regime, “he said.

Anti-vaccine currents in the Peruvian labor market

Minister Betssy Chávez clarified that, although the perfect suspension should have already ended, number 7 of Supreme Decree No. 179-2021- PCM allows companies to resort to that figure in case workers have not applied the vaccine against the new coronavirus . Along these lines, he regretted that there are groups of citizens who insist on attacking the health policies that the Government establishes due to the proximity of the omicron variant.

“Unfortunately, there is an anti-vaccine trend promoted by political sectors. They even make them sign an (exemption) card. There, for example, Congress could score a goal promoting public health, which is a legal asset, “he said.
