Director of Transparency in the Management of the Judicial Council, Tatiana Sampedroafter he explained that confiscation of property is a special procedure, which does not prosecute the perpetrator himself, but the property acquired through illegal actions, and the type of action is not prescribed.
After reviewing the Executive Board’s proposal, Sampedro explained, emphasized the reduction of procedural time, because for efficiency in the administration of justice, he proposes not only an increase in criminal types, but also a shortening of the procedural time, for example, the twelve-month investigation phase is shortened to three months. This temporary arrangement will allow the state to effectively recover the property, he said.
At the moment, explained Tatiana Sampedro, it is sad to see that the punishments were not strong in terms of property recovery.
The official pointed out that the urgent draft law includes the text that 90 percent of the funds returned by confiscation of property will be used for investments and social development. The remaining 10% will be used for the modernization of the State Attorney’s Office.
Representative Jorge PeƱafiel from the Construye movement, asked the legislative committee to consider concerns about the application of forfeiture, while enforcement is important to continue extinguishing ownership of illegal assets, those harmed in good faith must also be considered; For example, someone legally acquires assets as a result of their professional practice, work or commercial activities, but it turns out that these assets were involved in the crime of money laundering or drug trafficking; but it turns out that the termination of ownership of that property is declared, then it turns out that we are dealing with a person injured in good faith. This must be regulated by law, he noted.
Christian Gallo, criminal expert and university professorhe pointed out that the project talks about the articulation of several institutions for determining assets of illegal origin.
