Indecopi asks to withdraw Tottus ice cream from the Peruvian market

Tottus Hypermarkets reported that the National Institute for the Defense of Competition and Intellectual Property (Indecopi) ordered the cessation of the distribution and commercialization of the “Tottus” brand ice cream in the vanilla, lucuma and tricolor strawberry flavors in its presentation of 511 grams, because it would contain trans fats above the limits allowed by the norm.

The “Tottus” ice cream joins the Five Products That Exceed the Trans Fat Limit according to Indecopi after an investigation of a total of 45 food products. “It was identified that five of them would exceed the legal limits, while the remaining 40 would be below that limit or contain trans fats of natural origin, that is, they would comply with the provisions of the law in this regard,” they reported.

It should be remembered that other banned products They are the traditional recipe “Tottus” panettone of 900 g, the marbled Bimbolete of the Bimbo brand in its presentation of 165 g; Panettone with raisins and candied fruits, from the “Bell’s” brand in its 850 g presentation, and Cheese Tris, from the Frito Lay brand, in its 39 g presentation.

Through a press release, Indecopi indicated that these sanctioning processes began because the suppliers would have breached article 19 of the Consumer Protection and Defense Code, by marketing the aforementioned products with higher amounts of trans fats.

In addition, it reported that this decision under the Article 123 of the Code, in which it is specified that “(…) The procedures followed before Indecopi are of a public nature. To this extent, the technical secretary and the Consumer Protection Commission of Indecopi are empowered to order the dissemination of information related to them, provided that they consider it pertinent in view of the interests of the consumers concerned and does not constitute a violation of secrets. commercial or industrial ”.
