The Peruvian Government promulgated Law 31952, which establishes extraordinary measures for the acquisition of machinery and equipment by local and regional governments for disaster risk management.
From now on, regional and local governments may use up to 30% of the resources of the Regional Compensation Fund (Foncor) and a maximum of 50% of the Municipal Compensation Fund (Foncomun), as appropriate. for the acquisition of machinery and equipment for adequate disaster risk management within its jurisdiction.
The authorization for the exceptional use of Foncor and Foncomun funds for the purchase of machinery in the event of disasters, ordered by the Congress of the Republic last November, will remain in force until December 31, 2026.
The Regional Composition Fund (Foncor) is a fund made up of 2% of the operations affected by VAT and other resources, which is distributed to all regional governments under poverty criteria and the receipt of resources from other sources such as canons, royalties. , among others.
Meanwhile, the Municipal Compensation Fund (Foncomun) is a fund established in the Political Constitution of Peru, with the objective of promoting investment in the different municipalities of the country, with a redistributive criterion in favor of the most remote and depressed areas.
The Executive Branch, through the Ministry of Economy and Finance (MEF), will issue the regulations of this law within 30 calendar days from its entry into force.
Precisely, the acquisition procedures financed through the resources enabled by this law, as well as the deadlines for the acquisition of machinery and equipment from the imminent occurrence of an emergency situation, are established in the regulations.
Once the emergency situation due to a natural phenomenon has been overcome, local governments and regional governments must use the machinery and equipment acquired under the scope of this law for activities related to disaster risk management and for the maintenance of the public infrastructure within its jurisdiction.
