The Ministry of Labor and Employment Promotion (MTPE) modified the Regulations of the General Law of Labor Inspection and Defense of the Worker to facilitate virtual labor conciliations.
Through supreme decree 011-2023-TR, the MTPE changes eight articles of the aforementioned regulation with the purpose of “strengthening, modernizing and optimizing the operation of the administrative labor conciliation service, through the use of new information and communication technologies in order to provide timely care.”

For example, the analysis of the conciliation request and signing of the invitation to conciliate may be digital or holographic. At the time of dialogue, the conciliator may meet or conference virtually with any of the parties separately when circumstances may affect the free expression of the ideas of some of them.
From now on, face-to-face or non-face-to-face administrative conciliation is requested through the physical or virtual parties’ table, which is implemented by the Regional Directorates and Managements of Labor and Employment Promotion of the Regional Governments at the national level, and the organic units or dependencies. to take their place in charge of the worker’s free legal defense and advice
The conciliation hearing can be in person or not in person. In the event that the hearing is carried out remotely, the minutes are signed using the digital signature of the participants.
“If the Administrative Labor Authority, the parties or any of them do not have the digital signature, the hearing is suspended, setting a new date to collect the holographic signature. If during the non-face-to-face hearing there is a disconnection of the internet service, this is suspended, setting a new date for its restart,” the document states.
