Cinépolis continues to prevent customers from bringing their own food into the movie theaters

It has been warned that the Mexican cinema chain Cinépolis still does not allow customers to bring their own drinks and food to watch movies, despite the fact that Resolution No. 0219-2018/SPC-INDECOPI authorizes users bring supplies similar to those sold in the candy stores of these chains to the movie theaters. In addition, the signs that emphasize the restriction of bringing beer or soft drinks to these establishments are still maintained.

According to Jaime Delgado, lawyer and founder of the Peruvian Association of Consumers and Users (Aspec)this action is considered a crime and also represents an act of unfair competition compared to other Peruvian cinema chains.

“This issue has already been debated and has reached the Supreme Court, which has established that they are abusive and illegal clauses. At the time, they sanctioned Cinemark and Cineplanet for the same situation. It is striking that Indecopi allows this to Cinépolis, since cconstitutes an act of unfair competition and is obtaining advantages over its competitors and economic benefits”, he mentioned to La República.

It is important to note that, at the end of June, Indecopi was alerted to this situation and proceeded to inspect the Cinépolis premises in Plaza Norte and Larcomar using unknown consumers. However, so far, no action or sanction has been established.

What can I do if the cinema prohibits me from bringing in food?

The consumer code establishes that users have the right to receive an ideal service, which includes both quality in the establishment and an optimal screen, hygiene and safety in the movie theater, among other aspects. Added to this is the income from own food.

If an establishment does not comply with these demands, people can request the complaints book. In addition, you can go to the Indecopi offices or call 224-7777, if you are from Lima, or 0804-4040, if you are from the regions.

“Users pay to go see a movie, not to enter a cafeteria. Consequently, when Cinépolis prohibits eating in movie theaters unless you buy there, it is limiting the right of choice, since it ultimately forces you to pay even triple for food that is cheaper in other places,” warned Delgado.
