After being observed in August of this year by the Executive, the Law 31928 that modifies Law 29625 and allows the partial return of Fonavi contributions was promulgated in the official newspaper El Peruano, after having been approved by insistence with 94 votes in favor in the Plenary Session of Congress.

  • If none of the indicated links are available, the return would be made to those who prove they are debtors of the deceased Fonavista through intestate succession or a will.

If two or more debtors with equal rights request the refund, the total refund amount will be distributed equally.

Fonavi 2023: who will have priority for collecting their contributions?

As stipulated in the recent promulgation, priority will be given to people over the age of 60 years oldwhich are duly registered in the National Council for the Integration of Persons with Disabilities or suffer from terminal illnesses.

When do Fonavi contributions pay?

In order to access the refund of their contributions, the contributors or their relatives according to the degree of relationship indicated above must present a series of documents required by the Ad hoc Commission. Once this is done, the Technical Secretariat will publish on its website the number and data of the applicants for a period of 45 calendar days. The latter would occur so that if there are more debtors they can request said amount or, otherwise, oppose it.

When this period has elapsed, the applicant(s) may collect the required amount. However, if this exceeds 4 UIT, the link must be proven through an intestate succession or will registered in Public Registries. This process will be in charge of the Banco de la Nación and the start date for the delivery of contributions has not yet been confirmed.

What is Fonavi?

Is he National Housing Fundcreated by Decree Law No. 22591 on June 30, 1979. Its purpose was to progressively satisfy the need for living place of workers based on their income. It was in force from July 1, 1979 to August 31, 1998. Currently there is an Ad hoc Commission, made up of Law No. 29625, which is responsible for carrying out all the procedures and processes that are necessary to comply with the return of contributions, in addition to the administration and recovery of debts, funds, assets and liabilities.
