The congressman from Peru Libre Wilson Rusbel Quispe Mamani proposed a bill, which seeks to protect the single mothersgranting them an economic bonus of S/342, apart from other benefits. This proposal understands single mothers as all single, abandoned, separated, widowed or divorced women who raise their children under 18 years of age, without the physical presence or financial support of the father or any other man. This is determined by the National Comprehensive Program for Family Welfare (Inabif).

The objective of this proposal, according to PL 6345/2023-CR, is “to recognize the rights of single mothers in situations of poverty or extreme poverty, regardless of their marital status.” To this end, the bill cited Article 4 of the Constitution, which states that “the community and the State especially protect the child, the adolescent, the mother and the elderly in a situation of abandonment.” Find out in this note what it consists of and what benefits it would provide.

What does this bill consist of and what are the benefits to single mothers?

The bill presented by Congressman Wilson Quispe consists of 15 articles, among which he defines his objective, the public and the measures he would seek.

  1. Prohibit discrimination against single mothers.
  2. Right to state and social support
  3. Right to a monthly bonus, equivalent to 1/3 of the Minimum Living Remuneration (Currently it would be equivalent to S/342)
  4. Right of preference in labor hiring, through the delivery of tax incentives to employers who have at least 5% of the monthly average of their active workers on the payroll.
  5. Right of preference to daycare centers.
  6. Right to not be dismissed from work. This is considered up to 90 days after birth.
  7. Constitution of protection homes for single mothers, divorced, separated, widows who are pregnant and/or subject to violence, as well as for their daughters and sons under 18 years of age.
  8. Right of preference to credits, mainly with respect to mortgage or lease credits.
  9. Right to free medical care and medicines: This is valid until the moment these women leave the situation of single mothers and effectively receive the respective alimony, they will lose the right to this free medical care.
  10. Priority for single mothers from rural and indigenous areas.
  11. Right for the child to bear both surnames of the single mother.

What is needed to be granted the Bonus for single mothers of S/342?

This is a bill that has not yet been debated in the corresponding committee and, if approved, the regular process must continue with a debate in plenary. If it manages to overcome this second instance, it will have to be approved by the Executive or in the second instance.
