With the month of November underway, the deadline is approaching for private sector employers to pay the amount corresponding to the Compensation for length of service (CTS) to its workers. This labor right, which will be granted for the second time this year, will benefit anyone belonging to the private labor regime who has worked a minimum working day of four hours a day for a month between the months of May and October.
The amount to receive will depend on many factors, including the type of company to which the worker belongs (micro, medium and large company). Next, we will show you how to calculate the amount you will receive if you do not have a fixed remuneration.
CTS November 2023: how do I calculate my CTS if my salary is variable?
If the worker receives a variable monthly remuneration, the amount he will receive as CTS will be equivalent to the average of what he has received between the months of May to October.
However, there is also another way to calculate this amount if the worker does not receive a fixed amount every month. In this case, if the worker has a fixed salary, but receives a complementary amount each month, whether for overtime or other concepts, these amounts will also be considered in the calculation of said benefit, as long as they have been granted in three or more occasions within the period between May and October, in which case the concepts are added and divided by 6.
Who receives CTS?
- Workers who work less than four hours a day on average.
- Workers who receive 30% or more of the amount from the rates paid by the public for services.
- Microenterprise workers hired after the company registered with Remype.
- Workers in the agricultural labor regime who have chosen to collect their CTS together with their remuneration (Law No. 30110 and DS No. 005-2021-Midagri).
