The National Superintendency of Public Registries (Sunarp) is a State agency that provides various services to citizens and guarantees legal security mechanisms necessary to exercise the right to possess property. In this sense, the entity attached to the Ministry of Justice and Human Rights has been implementing a series of improvements to serve its users that are aimed at preventing documentary fraud and standardizing electronic registration presentations.

In this note, we tell you more details about the Sunarp Resolution published in the newspaper El Peruano that establishes the mandatory presentation of parties and notarial requests through the Digital Intermediation System (SID-SUNARP) as of November 2 . Pay attention!

What is Sunarp’s digital transformation about?

According to Resolution No. 169-2023-SUNARP/SN, it is established that as of November 2 of this year, the parties and notarial requests that contain acts to be registered in the legal registries in charge of the Superintendency of Registries Public (Sunarp), are mandatory to issue with a digital signature and are presented through the Digital Intermediation System (SID-SUNARP).

With this migration to electronic platforms, the aim is to streamline the legal traffic of goods, guarantee a procedure that prevents document falsification and decongest registry offices at the national level through the simplification of procedures. It is worth mentioning that the resolution also establishes that the registry offices will not accept the presentation of notarial documents and requests in paper form as of the entry into force of this rule.

Digital Sunarp: who is excluded?

The notarial parts and requests that must be submitted compulsorily through the SID-SUNARP only cover those issued by notaries in the country. Below, learn about the acts that are excluded from the scope of this resolution:

  • Instrumental transfers that are sent by consuls when they exercise the notarial function outside the country or those instruments granted abroad.
  • Instrumental transfers issued by the General Archive of the Nation or by the Departmental Archives, which correspond to the documentary collection of the dismissed notary.
  • The instrumental transfers of the set of documents of the dismissed notary, whose notarial protocol is under the administration of the Colleges of Notaries.
  • Extra-protocol public instruments that have merit for registration, in which presentation through the SID-SUNARP is optional.

In which cases will the electronic presentation of parties in Sunarp not be necessary?

  • ANDn cases of fortuitous events or force majeure such as lack of internet connectivity, technological incidents or others that prevent a time greater than two hours, the Registry Unit or the person responsible for the competent office will authorize the reception in paper format of the reports and requests notarial until the problem is resolved.
  • The physical presentation of the parties and notarial requests regarding the authorization carried out will not be subject to qualification by the registry authorities.

Sunarp: what is the Digital Intermediation System?

Known by its acronym SID, Sunarp makes available to users a service platform that allows them to carry out the registration procedure through the electronic presentation of documents with a digital signature from the notary. This tool is intended to facilitate the following acts:

  • Granting of powers in the Registry of Natural Persons
  • Constitution of companies (mypes)
  • Property transfer
  • Purchase and sale of vehicle in the Vehicle Property Registry
  • Acts that can be registered in the Registry of Intestate Successions.
