Operators must compensate users for internet interruptions

Through Resolution No. 000282-2023-CD/OSIPTEL, the Standard of Conditions of Use of Public Telecommunications Services has been modified. In this way, users who have suffered interruption of their fixed internet services for reasons attributable to the company, apart from receiving a refund of the payment corresponding to that period, They must be financially compensated for up to four times the value of what was reimbursed for the failure.

Thus, it is specified that the interruption of the service is not the responsibility of the user, except in cases of maintenance work or force majeure circumstances beyond the control of the operating company.

“This measure will allow the impact generated on subscribers by the interruption of service to be internalized. With this, operating companies will have greater incentives to reduce these interruptions, as well as provide prompt and due attention to their users when drops in their services are recorded,” explained the executive president of OSIPTEL, Rafael Muente Schwarz.

It is also established that compensation for interruption of service must be made jointly with the corresponding refund.

How will the amount that the user should receive be calculated?

In accordance with the standard published in the Peruvian, the amount of compensation to the subscriber for interruptionn will take into consideration a multiplying factor that will increase according to the duration of the failure.

Thus, in cases of interruption in the range of 60 and 300 minutes, the value will result from multiplying the refund amount by the factor 2.5.

“For practical purposes, if in said period, the remuneration to the subscriber for refund is one sol (S/1), The amount of compensation will result from multiplying said amount by 2.5, that is, S/2.50“, exemplifies Osiptel.

For interruptions of 300 to 700 minutes, the factor will be 3, while for those that exceed 1,440 minutes it will be 3.5. Finally, for cuts longer than 1,440 minutes the factor will be 4.
