Congressman Luis Picón Quedo, from We can Peruproposes that consumers receive up to 40% of the fines imposed by Indecopi or another regulatory body with the aim of motivating the reporting of this type of practices. This amount would be considered “notifying”, but not “compensatory”, as specified in the document.
Bill No. 6129 seeks to modify article 110 of Law No. 29571, Consumer Protection and Defense Code, which would establish the following amounts:
- For minor infractions, with a fine of up to 50 UIT, you get an incentive of 40% of the total fine
- For serious infractions, with a fine of up to 150 UIT, you get an incentive of 30% of the total fine
- For very serious violations, with a fine of up to 450 UIT, you get an incentive of 20% of the total fine.
It is important to note that, from January 2020 to February 2021, Indecopi has imposed 385 sanctions, whose most recurrent infractions are related to lack of suitability (S/583 million), unrecognized operations (S/25 million 283,280) and the claims book (S/6 million 446,880), according to the legislative initiative.
