Holiday of December 9 would apply from 2022

The Plenary of Congress declared the day December 9 each year as a national non-working holiday, commemorating the historic Battle of Ayacucho, which consolidated the independence of America. In this way, the holidays this month for the public and private sectors would now be three: the 8, 9 and 25.

The debate, which was settled in a second vote with 95 votes in favor, 19 against and 2 abstentions, It must now be endorsed by the President of the Republic, Pedro Castillo, within the next 15 days. As explained by the professor of Law at the Universidad del Pacífico Ana Neyra, it is very likely that the new law will obtain the approval of the Executive.

“Normally, holidays are declared with a law. At some point, they were raised by decree at the time of COVID-19, in the previous Government. Beyond that, there is no other requirement of the standard. Here what should be seen is whether, politically, the Executive will agree. Most likely, yes ”, says the specialist.

It should be noted that it is not the first time that the restitution of December 9 as a non-working holiday has been proposed, one of them was in 2019. Today the initiative comes to fruition by the hand of Peru Libre and the legislator Germán Tacuri, who argued that this measure will encourage transversal tourism as part of the economic reactivation with crafts, restaurants, transportation, among others.

Double pay

The professor of the Antonio Ruiz de Montoya University Christian Sánchez considers this statement positive, since in the 90s several of these dates were suppressed. In this sense, he explained that its promulgation will imply double remuneration for those who work on this day from 2022, like all holidays of this type on the calendar.

However, the also former Minister of Labor said that there are more urgent issues for workers that should be the subject of debate in the Congress and the Executive, such as atypical days (14×7) and collective bargaining, among others.
