Petroperú will continue to manage the South West Natural Gas Concession until 2026

The Executive Branch, through the Ministry of Energy and Mines (Minem), commissioned Petroperu the provisional administration of the Concession of the Natural Gas Distribution System through the Pipeline Network of the South West Concession.

This responsibility covers the operation and maintenance of said system, as well as the provision of the public natural gas distribution service in the regions of Arequipa, Moquegua and Tacna, in accordance with the provisions of Legislative Decree No. 43, the Law of Petróleos del Perú, and article 3 of the Regulations of Law No. 28840, known as the Law of Strengthening and Modernization of the Petróleos del Perú Company, approved by Supreme Decree No. 012-2013-EM.

The rule, in its recitals, highlights that this decision has been made taking into account that the new promotion process is in progress that allows the South West Concession to have a concessionaire; with the purpose of not affecting the continuity of the provision of the public natural gas distribution service through a pipeline network for more than 12,000 existing users in said regions.

The special assignment is granted for a period of up to three calendar years, which will come into effect on December 20, 2023, in accordance with the provisions established in the “Special Commission Framework Agreement for the provisional administration of the concession of the natural gas distribution system through the pipeline network of the South West Concession.” The current agreement expires on December 19.

Supreme Decree No. 019-2023-EM, published today in El Peruano, states that for the purposes of the execution of this special order, as well as for the provision of the public service of natural gas distribution through a pipeline network, Petroperú is responsible for compliance with the obligations established by the regulatory framework that governs the activity of natural gas distribution through a pipeline network, in relation to technical and safety aspects, quality of service, user service; and any other applicable aspect; as well as the applicable regulatory framework in environmental matters, being subject to the supervision, inspection and sanction functions of the competent entities.

The legal device is endorsed by the Ministry of Energy and Mines and bears the signature of Óscar Vera Gargurevich, current head of the sector, and the President of the Republic, Dina Boluarte.
