The legal report recommended filing a lawsuit for violation of Article 279 of the Code of Democracy, paragraph 2 on non-compliance with the legal orders of the competent electoral bodies and paragraph 12 on non-compliance with the decisions of the State Electoral Council. or TCE decisions.

However, it is not specified whether the report will be against the chairman of the Board of Directors of IESS, Alfredo Ortega or against Diego SalgadoDirector General of Social Security.

The resolution was approved by the votes of Councilors José Cabrera, Diana Atamaint and Esthela Acero; Councilor Elena Nájera abstained, and Vice President Enrique Pita did not attend the virtual meeting.

Treatment of this issue has been pending since last Thursday, after the president Diana Atamaint interrupted the session because the plenary session did not support her to receive the president of the IESS Board of Directors, Alfredo Ortega, and the general director, Diego Salgado, in the main committee.

The reform of the Social Security Act established that the IESS Administrative Council will a representative of the insured, a representative of employers and one from the executive functionwho will hold office for four years and can be re-elected for the same representation only once.

Candidates for main and alternate members, before participating in the elections, will be qualified by the State Electoral Council, in addition to the technical criteria, experience and conditions established by this Law and regulations.

These bodies will be elected by voting, and the Electoral Council is in charge of organizing the call, election and appointment process at the end of each period.

In order to achieve this, electoral colleges must be formed that will consist of presidents or top representatives of organizations with legal status, which are related or identified with social security issues, both in the sector of active workers and in the self-employed sector. workers, farmers, retirees, among others and employers in general, can present their couples and participate in the selection of representatives for main and alternate members, with a maximum of one couple per organization.

In March and June of last year, the CNE, through resolutions, requested that IESS send this data by July 12. But in several responses, IESS reported that not everyone paid attention to its requests.
