During the plenary session on September 28, the plenary session of the National Electoral Council was acquainted with the legal report recommending the filing of a lawsuit before the Electoral Court (TCE) against the highest authority of the IESS (Alfred Ortega), for the commission of the alleged electoral violation.

This would be for violation of Article 279 of the Code of Democracy, number 2, on disobeying lawful orders issued by competent electoral bodies, and number 12, on failure to act on the decisions of the State Electoral Council or the decisions of the TCE.

The report also proposes that Ortega, as the highest authority of the IESS, be asked to send a list of presidents of organizations with legal status related to social security issues, including active workers, farmers, among others; as well as employers’ organizations, business administrators or employers from the private sector.

However, this recommendation was not discussed because Council President Diana Atamaint decided to interrupt the plenary session attended by members Elena Nájera, José Cabrera, Esthela Acero and Andrés León, who was the main member due to his absence. Enrique Pit.

At the beginning of the session, Atamaint received Alfredo Ortega, President of the Board of Directors of IESS, and Diego Salgado, General Director of IESS, as the main committee.

However, councilors Nájera and Acero expressed concern about the delay in the process.

Nájera emphasized that the electoral offense was set up and that the appeal should have been submitted to the TCE.

“It seems to me that they are trying to save civil servants in such an important matter. Because that’s why the members were not renewed. It is up to you and your duty to file a complaint in the civil election court, because it is not a question of listening to someone who has not fulfilled what he should have fulfilled. The Law on the Reform of the Social Security Law – effective from November 2022 – amended the integration of the collegial body and establishes that the IESS Board of Directors will a representative of the insured, a representative of employers and one executive director, who will hold office for four years and can be re-elected for the same representation only once.

Candidates for main and alternate members, before participating in the elections, will be qualified by the State Electoral Council, in addition to the technical criteria, experience and conditions established by this law and regulations.

These bodies will be elected by voting, and the Electoral Council is in charge of organizing the call, election and appointment process at the end of each period.

In order to achieve this, electoral colleges must be formed that will consist of presidents or the highest representatives of organizations with legal status, which are related or identified with social security issues, such as from the sector of active workers, self-employed workers, peasants, retirees, among others; and employers can generally present their pairs and participate in the selection of representatives for main and alternate members, with a maximum of one pair per organization.

In March and June of last year, the CNE, through resolutions, requested that IESS send this data by July 12. But in several responses, the organization reported that not everyone heeded its demands.
