Congressman Flavio Cruz Mamani, from Perú Libre, proposes that the increase in remuneration of 10% of the monthly salary be recognized for active and laid-off workers who contributed to the National Housing Fund (Fonavi), as provided in article 2 of the Decree Law No. 25981. There would be almost 1 million people who provided services in the public sector who would benefit from this standard.according to the National Federation of Fonavistas and Pensioners Association of Peru (Fenaf Perú).

Bill 5988 indicates that there are two conditions that must be proven to be a beneficiary: having been a dependent worker with remuneration affects the contribution of the Fonavi and having had a valid employment relationship as of December 31, 1992. In addition, it is specified that pending judicial proceedings will not be an impediment to compliance with the provisions of the standard.

Decree Law No. 25981, in force since January 1993, modified the contribution rate to Fonavi by 9% – when it was previously 1% – and established that workers with a contract valid as of January 1 of that same anus They will have the right to receive an increase in their remuneration equivalent to 10%. A measure that was never carried out and that has been a reason for many workers to opt for judicial means.

“Public sector workers have been enforcing Law 25981 in trials individually, there are some cases that they have already won, but that demands resources and time, being a Law, its application in the public sector should have been automatic. So it is a great initiative of Congressman Flavio Cruz that we from the Fenaf Peru Association support,” he told The Republic Jorge Milla, member of the union that represents the Fonavistas.

The initiative must be evaluated by the Congressional committees before going to the Plenary Session for debate and voting. If approved, the Executive will have 60 days to regulate it.
