The Executive Branch promulgated this Saturday the Law 31876which proposes to regulate the process of execution of works by direct administration at the national level so that they are carried out under the best conditions of quality, cost and deadline.
The device, approved by Congress last week, seeks to make honest, transparent, efficient and effective use of the resources and assets of the State, at the national level, allowing the institutional objectives of the entities to be met and the public purposes for which which public works are planned.
The entities subject to the scope of Legislative Decree 1440, Legislative Decree of the National Public Budget System, and Legislative Decree 1439, Legislative Decree of the National Supply System are included within the scope of this law, under the generic term of Entity. , that execute public works by direct administration, regardless of the source of financing they use.
From now on, the execution of works by direct administration, in addition to the principles that govern public, administrative and financial law, where applicable, is governed by the principles of morality, efficiency, transparency and economy.
Within the framework of the execution of a work by direct administration, the acquisition, under any form, of machinery and equipment charged to the budget of the work is prohibited.
The National Control System carries out concurrent control over the execution of investments with infrastructure components by direct administration, prioritizing the use of technological tools for its supervision, in accordance with the regulations established by the Comptroller’s Office.
