More than 200,000 mypes would benefit from invoice payment within 30 days

Of the 2.5 million micro and small businesses (mypes) in the country, at least 200,000 would benefit from the recent law that regulates the payment of 30-day invoices.

This is how the director of Mypes Unidas del Peru estimates it, Daniel Hermoza, who explains that this rule allows the timely payment of commercial invoices or receipts for fees paid to companies in the private sector and the public sector.

The businessman also specified that, having promulgated the law a couple of weeks ago, the Ministry of Economy and Finance (MEF) has up to 90 days to publish the operating regulations, Therefore, he hopes that in the first quarter of next year the mypes can begin to benefit from this rule.

Liquidity to mypes

According to the law, the payment of the total amount of the invoices or receipts for fees issued by the provider of a good or service must be effectively paid within a maximum period of up to 30 calendar days, from the date of issue. .

However, if a payment has been agreed in installments, the respective payment dates of each of them must be indicated, taking into account that the first installment is paid within 30 calendar days of the presentation of the invoice. or receipt for fees.

Also, exceptionally, the supplier and the purchaser of the good or user of the service may establish, by mutual agreement, a different term, provided that said agreement is in writing.

One aspect that Hermoza highlights is that the law incorporates default interest if the payment of the invoice or receipt for fees is not made within the 30 days established by the norm.

For this, the moratorium interest rate will be calculated in accordance with the criteria established by the Central Reserve Bank of Peru (BCRP), which will be specified in the regulations to be published.

It is important to mention that, for 180 days, the payment of the amount of the invoices or receipts for fees, in the case of private companies, can be made within a maximum period of 60 calendar days.

For its part, Raúl Odría, professor at ESAN Business Law, pointed out that although it is a beneficial rule for small companies, it would be undermining free negotiation between companies, since payment terms are required.
