Congress proposes granting tax benefits to agricultural producers

The congressman and president of the Agrarian Commission, Enrique Castillo, from Fuerza Popular, presented the bill to create the exceptional regime for the return of General Sales Tax (IGV) to agricultural producers, establishing the tax procedure for compensation and refund of this tax on the acquisition of inputs, raw materials, other goods, servicesconstruction contracts and import policies that are taxed.

According to bill 5861, access to tax benefits will be provided that the acquisitions of goods and services are with electronic payment receipts, with exceptions. Includes agricultural producers who are registered in the General Regime, MYPE Tax Regime (RMT), Special Income Regime (RER), Agrarian Regime and the Single Simplified Regime (New RUS), and who produce certain foods specified in the annex. 1 of the standard.

Lemons, oranges, grapes, potatoes, tomatoes, lettuce, asparagus, among more than 60 other tariff items.

“The amount of the VAT recorded in the payment receipts for the acquisition of goods, services, construction contracts and import policies, which are in the name of the agricultural producers indicated in article 2, will give the right to a balance in favor of the agricultural producer, as provided in the Regulations of this law,” it is stated.

The explanatory statement states that the exoneration of VAT to food since 1996, through Legislative Decree 821, generates a financial cost to producers, in addition to having a differentiated tax treatment compared to those who send their production abroad. In this way, the proposal seeks to level the playing field.

The legislative initiative must still undergo evaluation by congressional committees before going to the plenary session for debate and voting.
