They approve prediction of the bill that regulates electronic commerce

The Consumer Defense Commission approved by 12 votes in favor and one abstention the prediction of the bill that modifies the Consumer Protection Code, regulating electronic fraud and sanctioning computer fraud.

The project is based on the work called Proposal for consumer protection in electronic commerce and product safety, previously carried out by Indecopi.

In addition, it is based on bill 415/2021-CR and seeks to fill the gap in the consumer protection code regarding purchases made through electronic commerce.

In this way, it adds new concepts related to marketing in these channels and aims to establish a minimum standard of compliance in transactions carried out in digital media to guarantee the safety of consumers.

The standard requires the local presence of suppliers and consider the process of purchase confirmation and receipt for said operation. In addition, it regulates the right of repentance of the consumer for the purchase made.

The proposal also seeks to create a virtual window so that users can report the telephone numbers and emails from which computer fraud is carried out.

The only abstention from the commission was the congressman from Fuerza Popular Alberto Morante Figari, who asked that the Presidency of Indecopi and SBS to explain what real possibilities exist for electronic commerce to be audited.

“Our bills are legal and, as a result, they must be duly supported,” he said.
